TAR Calabria, Reggio Calabria, October 7, 2009, n. 629 - In the presence of even a single episode of goliardia or otherwise of exuberance among classmates, is legitimate enough to conduct an evaluation of school by the Authority in relation to its author, when the incident in question may be considered expressive of a general and more entrenched oppressive attitude, which is such as to constitute an adverse environment for some of his classmates, according to the prudent discretion of the school itself, which is responsible for both educational and pedagogical evaluation of the relevance of the facts, and the consequences and educational activity which is called a duty to correct the imbalances that produced it.
